教保員體罰學童 判拘役50日

（中央社記者廖壬楷台中17日電）何姓教保員在去年1月，以幼兒園學童表現不佳為由，徒手拍打學童雙手手臂內側數次，遭法院依故意傷害兒童罪判拘役50日。

台中地方法院判決書指出，何姓教保員在民國102年1月7日下午，以學童表現不佳為由，徒手接續拍打學童雙手手臂內側各數次，導致學童雙手手臂紅腫瘀血及右肘關節挫扭傷。

經學童母親提告，何姓教保員庭訊時坦承，有徒手接續拍打學童雙手手臂內側各數次，但否認有傷害犯行，並辯稱是因為學童上課不專心，用餐速度非常緩慢，還傷害其他小朋友，情急之下才用手制止。

此外，何姓教保員也表示，她是善意導正，非蓄意傷害，且隔著體育服輕拍學童雙手手臂，沒有傷害學童可能。

法官認為，何女身為教保員，理應秉持保護兒童身心健全發展的職責，竟恣意傷害被害學童，損害學童身心健全發展，且未與被害人、告訴人達成和解，未見深切悔意，依故意傷害兒童罪判處何女拘役50日，得易科罰金，全案可上訴。1030917
