牙醫墜樓亡 妻獲賠160萬確定

一名住在新北市的牙醫師五年前從住家頂樓墜樓，死者家屬認為，牙醫平時有到頂樓抽煙思考的習慣，很可能不慎墜樓，但保險公司卻以自殺為由，拒絕理賠，雙方鬧上法院。最高法院審理後，判決保險公司敗訴，要理賠死者家屬一百六十萬元確定。

判決書指出，民國98年10月26號凌晨，38歲的曹姓牙醫在新北市鶯歌區的住家頂樓墜樓死亡。曹姓牙醫的妻子不滿保險公司以疑似自殺為由拒絕理賠，所以提告求償。牙醫的妻子主張，丈夫生前任職牙醫診所，有優渥收入，經濟狀況良好，而且家庭和諧，墜樓前還陪兒子講故事、安撫女兒，也沒有留下有遺書，沒有尋短異象。

由於高院審理期間，曾多次勘驗案發現場，發現曹姓牙醫身高185公分，女兒牆只有112公分高，曹姓牙醫可能不慎因精神不濟、誤判陽台邊緣高度等原因墜樓，而且保險公司的舉證都無法排除「意外傷害事故」，牙醫墜樓可能性存有多種可能，所以認定事故應屬意外，判決保險公司應給付死者家屬160萬元保險金。保險公司不服上訴三審，全案經最高法院駁回上訴定讞。
