因公撫卹 申請無門 猝死警家屬控：樹林分局吃案

過勞冤魂又一條！拿出員警王琮郁的值勤班表，家屬在民進黨立委吳宜臻的陪同下，哽咽表示，王琮郁生前服務於新北市樹林分局，每周至少連續值勤27個小時，每月加班超過72小時，最後在今年8月7日過勞死亡，留下兩個月大的孩子。吳宜臻說，事發至今，樹林分局恐有意吃案，家屬想申請因公撫卹卻求助無門。

吳宜臻指出，警察勤務條例雖規定基層警察每天服勤8到12小時，王琮郁的個案卻凸顯了變形工時的問題。此外，樹林分局說無法爭取因公撫卹是因為因公撫卹的認定，首先是以「在家」還是在「執行勤務」來認定，王琮郁是在家過世，因此無法被認定是因公撫卹。

銓敘部退撫司副司長陳紹元回應，因公撫恤必須由服務單位主動申請，銓敘部已組成因公撫卹疑義案件審議小組審視個案，但尚未收到樹林分局的申請書。

警政署及樹林分局則表示，申請因公撫卹必須由家屬主動提供法醫解剖報告、健保資料等，從9月26日起已積極辦理，目前正在作業中。
