馬總統08年競選時承諾任內將杜絕非法監聽的主張，自始注定要以法治笑話收場，其自九月政爭以來的作為是證據之一，而《通保法》現行架構在威權統治心態下，根本是肆意非法監聽的溫床，更加速催生了這場笑話。

展現威權統治心態

目前監聽數據眾說紛紜的現象，源自於我國從未建立由國會監督的年度通訊監察報告（annual wiretap report）制度，以透明資訊作為公開辯論的事實基礎，長期以來僅以內容簡陋的司法統計年報敷衍了事。以美國法制為例，向國會提交通訊監察年度報告，內容包括了申請監聽之案件數、監聽案由類型、准駁比例、監聽期間統計、續行監聽比率、監聽方法、監聽地點及種類、監聽投入成本、監聽案件起訴率和定罪率等等，都是基本的揭露項目。
反觀我國，最近卻發生監聽統計數據公布後，司法院以國安局「事後來函要求撤除」為由，將已公開上網的國安監聽資料撤下的荒謬情事。
倘若行政院要和司法院建立兩院合作平台，全面檢討現行監聽制度的承諾為真，恐應採取更積極的作為，而非大聲宣示特偵組檢察官聲請監聽0972節費電話程序並無違法；否則，充其量只展現了藐視《通保法》第22條以下的處罰規定和國家賠償規定的傲慢，以及混淆視聽並護短的威權統治心態。
《通保法》第14條第2項 規定電信業者的協助執行通訊監察義務，但《通保法》施行細則卻建立了具有超越母法授權嫌疑的管制架構。該法施行細則第26條規定：「電信事業及郵政事業應使其通訊系統之軟硬體設備具有配合執行通訊監察時所需之功能……必要時並應提供場地、電力及相關介接設備及本施行細則所定之其他配合事項」，內容可以包山包海，並在第21條規定電信事業為協助執行通訊監察，應「將電信線路以專線接至建置機關監察機房」，並由NCC掌握要求電信業者配合的裁決權力。
試問：監聽既屬個案執法，在此種各通訊監察中心可以透過永久性專線隨時鍵入監聽指令的架構下，電信業者如何發揮其維護客戶通訊隱私的基本守門功能？如果中華電信事前實質檢視過0972這張監聽票的內容，何來烏龍監聽？倘若在《通保法》的架構下，電信業者連如此基本的正當程序都未參與，豈非電信業者和政府聯手糟蹋你我的通訊隱私？

無辜公民隨時待宰
那麼，當檢警調偵查非屬《通保法》規定犯罪類型的一般疑似違法行為時，到底是如何向配合度極高的公私部門調得人民的電話和網路等通訊資料？政府如果真想杜絕違法監聽，除了修法要求法官核發調取票制度外，是否應該先開誠布公地說明過去至今檢警調辦案手法，是否都符合民主國家的令狀主義基本要求？例如，當政府向Google和Facebook調取人民網路活動資料時，法律授權依據和程序控制究竟何在？
法務部監聽事件調查報告是未能服人的低劣戲碼，本屬意料中事；那麼，在目前的監聽架構下，到底誰該害怕非法通訊監察呢？恐怕不是基於各自政治利益繼續交相指責推諉的政客，而是隨時隨地任人宰割的無辜小民。

本人最近在做專題Android APP，我是使用App Inventor來製作APP程式，我發現它裡面有一個元件是LocationSensor，我知道它的功能是抓取目前所在位置的經緯度，但是在SAMSUNG S3的實機上測試，他抓不到手機所在地方的經緯度(有開GPS)，同樣APP程式我用HTC的手機實機上測試，結果他能抓到經緯度，這是為什麼呢?是三星手機的本身問題嗎?
