音樂創作人徐德興被控抄襲歌手阿吉仔「好歹攏是命」，改詞成鄉土劇男星王燦「夜市的人生」。台北地院依違反著作權法判刑5月。

法院判決指出，阿吉仔在民國88年發行「好歹攏是命」，是知名創作人徐嘉良作品，並由環球音樂取得專屬授權。

法院判決指出，徐德興明知如此，竟未經對方同意，在98年以清唱方式擅自重製抄襲曲調、搭配自己創作的歌詞，命名成「夜市的人生」，交給不知情的藝人王燦演唱，收錄在他於100年發行的首張個人專輯。

環球音樂發現後報警處理。法院審理時，被告否認抄襲，辯稱是觀察夜市攤販生活自行創作出「夜市的人生」詞曲；律師辯稱，台語歌曲曲風相近，兩曲雷同純屬巧合。

但法官請專門研究流行音樂的輔大音樂系系主任徐玫玲鑑定發現，兩曲旋律相似度超過9成。被告也坦承自己無法把詞曲寫成樂譜。法官認定他擅自以重製方式侵害他人著作財產權，判刑5月，得易科罰金新台幣15萬元，全案可上訴。(中央社)
