桃園一名蕭姓男子，長年在外從事駕駛工作，不常和妻子相處，和她早已形同陌路，沒有任何夫妻情分存在，兩人因此在十年前離婚。去年5月兩人為管教子女問題發生爭執時，前妻脫口而出「小孩又不是你的！」蕭男一聽又氣又驚提出否認子女告訴，法院最後裁定4名子女非他所生。

蕭男和前妻在民國82年結婚，並在81年、83年、86年、89年陸續產下4名子女。十年前兩人離婚後，蕭男仍非常關心子女，經常探視小孩，無奈他們不領情。後來，蕭男又提出希望子女能和他同住的要求，卻得不到正面回應。

蕭男因此和前妻發生爭執，前妻一氣之下脫口而出「小孩不是你的！」蕭男聽了氣得向法院提出告訴，法院審理期間，4名子女拒絕到庭，也拒絕配合親子血緣鑑定，法官認為4名子女放棄權益，因此採取蕭男主張，判決4名子女均非前妻自蕭男受胎所生之子。
