停車場升降機擾鄰　社區賠住戶13萬元

【劉昌松／台北報導】居住在台北市內湖區的劉姓男子不滿社區停車塔設備時常發出噪音，害住他晚上時常被驚醒，因此得了焦慮、憂鬱症，打官司要求社區管委會改善，高院認為，社區停車設備改善後的噪音分貝，已符合政府標準，但管委會先前侵害劉和妻子居住安寧，應賠償13萬元。本案還可上訴。

劉男向法院表示，他們住在社區2樓，就在社區停車場出入口正上方，停車機械的噪音經常侵入家中，影響居住安寧和身體健康，原本一審時，士林地院根據現場噪音測量結果，認定停車場的音頻已經超過政府規定，因此判社區應將噪音降低，並判賠劉男5萬元。

社區敗訴後找人進行改善、維修，並上訴高院，法官再找環保局測量，證實停車場晚間產生的噪音，的確已經低於噪音管制標準，因此判社區不用再進行改善。但考量劉和妻子先前已經被噪音困擾1年，因此判社區管委會應賠償劉8萬元，劉妻5萬元的精神撫慰金。
