性侵殺害葉小妹僅判無期　總長提非常上訴

【綜合報導】性侵累犯林國政假釋40天就犯下震驚全國的雲林葉小妹姦殺命案，一、二審均判死，最高法院卻以智能低下等理由，日前改判無期徒刑定讞。立委王育敏看不下去聲請非常上訴，檢察總長黃世銘調查後認定，最高法院擅自摒棄專業鑑定、無視卷證顯示林男非智能低下，判決顯有適用法則不當、率斷、邏輯推演令人不解等重大違失，昨正式提起非常上訴，要求更審。

最高法院回應：「等收到非常上訴書，會依法律程序處理。」但根據《刑事訴訟法》規定，對於被告不利的非常上訴案件，更審刑度不能對被告不利，亦即若原確定判決判無期徒刑，非常上訴的結果，就不能改判被告死刑。
