〔自由時報記者陳璟民／台北報導〕馬英九總統昨召開記者會，以強烈政治鬥爭口吻，批判正在馬來西亞嫁女兒的立法院長王金平涉嫌關說侵犯司法，民進黨主席蘇貞昌昨晚召開記者會，砲轟馬英九為打擊政敵，竟以總統之尊，採取非法違憲手段，這是台灣人權最黑暗的一天；馬逾越憲法職權，兩度召開記者會，鬥爭打擊政敵，還把自己的犯罪行為正當化，這是台灣民主政治最黑暗的一天。

「台灣人權最黑暗一天」 蘇轟馬違法監聽

馬英九昨強力批判王金平涉關說，並自居為法官強調「如果這不是關說，那什麼才是關說？」但對於濫權監聽未做任何交代，由於最高檢特偵組濫權監聽嚴重侵害人權，蘇貞昌昨晚表達民進黨確保人權的嚴正立場。

批馬非法違憲 還將犯罪正當化

對於馬英九與馬團隊近日一連串的政治鬥爭大動作，蘇貞昌昨晚九點召開記者會表示，台灣正面對違反憲政分際的國家危機，很遺憾的，這個危機竟是由最必須遵守憲政秩序的總統一手造成。

蘇貞昌表示，八月卅日當天，當檢察總長黃世銘拿著非法監聽的資料向馬英九報告時，這種洩漏偵查資料的行為就是違法；馬未迴避，反而直接參與個案，由特偵組非法公布所監聽的譯文，更是違反通訊保障及監察法的犯罪行為，這是台灣司法最黑暗的一天。

斥馬為打擊政敵 逾越憲法職權

他批評，馬英九上任以來，人權倒退，國際再三關切，如今馬為了打擊政敵，竟然以總統之尊，採非法違憲的手段，這是台灣人權最黑暗的一天；馬逾越憲法職權，兩度召開記者會，鬥爭打擊政敵，還把自己的犯罪行為正當化，這是台灣民主政治最黑暗的一天。

蘇貞昌認為，馬英九透過不法的監聽手段，竊取國會議長通聯內容，扭曲司法人員的正直，甚至直接參與司法偵查中的個案，自己作判決，這種操弄司法的作法，已逾越憲法賦予總統應有的職權，如果馬可以這樣違法、違憲，還有什麼不能做？

他以詰問口吻總結，「如果這不是政治鬥爭，什麼才是政治鬥爭？如果這不是干涉司法，什麼才是干涉司法？如果這不是違法手段，什麼才是違法手段？如果這不是憲政危機，什麼才是憲政危機？」
