父親前陣子車禍受傷腳與顏面骨折,住院10天,診斷書上說明需人照護6周與宜修養三個月,另有機車損毀..等

事故原因經過:

我方機車過閃紅燈(肇責:閃燈號誌路口支道,支幹未讓主幹)(另監視器畫面我方有減速再騎)

對方大貨車過閃黃燈(肇責:未注意前車狀況)(初步分析研判表對方煞車痕超過10公尺..)

請問:

1.對方有強制險與任意險,我方有強制險與附加駕駛人傷害險,該如何理賠?

2.強制險的理賠項目會因為保險公司的差異而有所不同嗎?因為看護費不是規定一天1200元嗎?若低於此數保險公司是否違法?

3.強制險不分責任歸屬,受傷的一方是否可要求強制險該有的理賠?

4.任意險此部份是否有責任歸屬的問題?若有通常是否如何判定?此部份是與對方當事人請求理賠還是對方保險公司一同分擔?
